1. Conclusion of Contract

1.1 Our product listings in the Femkit online shop are a non-binding invitation for you to place an order with us.

1.2 By submitting your order, you are making a binding offer to enter into a purchase contract.

1.3 The acceptance of your offer takes place upon delivery of the goods. The automatically generated order confirmation email does not constitute acceptance of your offer, but merely confirms receipt of your order. Whether we accept your order is at our discretion. If we are unable to accept it, we will inform you promptly and refund any payments already made.

1.4 When selecting the “Click & Collect” pickup option, the online order initially serves solely as a reservation of the goods for personal collection. A purchase contract is only concluded upon personal collection and acceptance of the goods at the Femkit Store. The order confirmation or reservation confirmation does not yet constitute acceptance of the offer. We reserve the right to reject reservations; any payments already made will be refunded promptly in such cases.

1.5 We sell exclusively to consumers aged 18 and older, and only in quantities customary for household use.

1.6 The ordering process consists of the following steps:

• Selection of the desired products

• Login or entry of personal information

• Entry of billing and shipping address and selection of payment method

• Final submission of the order, with the option to print a confirmation

2. Contract Language and Storage

2.1 The contract language is German.

2.2 We do not store the complete contract text. You can print your order details using your browser's print function before submitting your order. After receipt of the order, we will email you the order information, legally required details, and these Terms and Conditions.

3. Minimum Order Value / Shipping

3.1 The minimum order value is 25 EUR.

3.2 Standard shipping costs:

• Germany: 5.95 EUR (free shipping for orders over 150 EUR)

• EU: 15.00 EUR (free shipping for orders over 150 EUR)

3.3 Shipping outside the EU: 45.00 EUR (free shipping for orders over 350 EUR). Customs duties and import taxes must be paid by the recipient. Deliveries to parcel lockers are not possible in non-EU countries.

3.4 Shipping to the USA: 75.00 EUR (no free shipping).

3.5 Express shipping (EU countries only): 45.00 EUR.

3.6 Shipping time: approx. 5–7 business days after the order date.

4. Prices and Payment Methods

4.1 Prices at the time of order apply. All prices include the legally applicable VAT. Prices may vary depending on the destination country.

4.2 Payment is made using the payment methods offered during checkout.

4.3 You agree to prepay using the selected payment method.

4.4 The total amount is due immediately and must be paid no later than 7 days after ordering. If payment is not received in time, we reserve the right to cancel the order.

5. Retention of Title

The goods remain our property until full payment has been received.

6. Right of Withdrawal

6.1 Right of Withdrawal

You have the right to withdraw from this contract within 15 days without giving any reason. The withdrawal period begins on the day you or a third party designated by you (who is not the carrier) received the goods.

To exercise your right of withdrawal, a simple written statement (e.g., via email or post) is sufficient. Alternatively, you may use our return portal.

6.2 Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, minus the return shipping fee (see 6.3), within 14 days of receiving your return or withdrawal notice.

The refund will be issued using the same payment method used in the original transaction.

We may withhold the refund until we have received the returned goods or you have provided proof of return—whichever comes first.

You must return the goods within 15 days of notifying us of your withdrawal. The deadline is met if the goods are shipped before the 15-day period expires.

6.3 Return Shipping Costs

• Returns within Germany: flat fee of 5.95 EUR, deducted from the refund

• Returns within the EU: flat fee of 15.00 EUR, deducted from the refund

• Items must be returned in original condition (unworn, unwashed, unaltered, with all original tags)

• Returns are at your own risk. Please keep the shipping receipt as proof.

6.4 Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

• Items that have been tailored or personalized according to your individual needs (§ 312g para. 2 no. 1 German Civil Code (BGB)).
• Purchases concluded after a personal fitting in our Berlin Concept Store, Danziger Straße 174, 10407 Berlin.

7. Warranty

Unless otherwise agreed, the statutory warranty provisions apply.

8. Copyright and Trademarks

All content on our website – including text, images, graphics, videos, sounds, and software – is the property of Femkit or its licensed partners and is protected by copyright. Any use without express permission is prohibited.
All trademarks used are the property of Femkit or third parties and may not be used without written consent.

9. Data Protection

9.1 Your personal data will be processed in accordance with applicable data protection laws and used only to process your order.

9.2 For more information, please refer to our Privacy Policy.

10. Applicable Law

10.1 German law applies. For consumers, this applies only if it does not deprive them of the protection afforded by mandatory laws in their country of residence.

10.2 The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
